Taraflar\u0131n bo\u015fanmay\u0131 kabul etmesi ve velayet, nafaka, tazminat gibi taleplerde uzla\u015fm\u0131\u015f olmas\u0131 h\u00e2linde mahkemece ivedi bi\u00e7imde karar verilerek taraflar\u0131n bo\u015fanmas\u0131na h\u00fckmedilir.<\/p>\n<p>Anla\u015fmal\u0131 bo\u015fanma davalar\u0131nda taraflar\u0131n kusur oranlar\u0131 \u00f6nem arz etmez. Keza yine taraflar\u0131n neden bo\u015fanmak istedikleri de mahkemece dikkate al\u0131nmaz. Taraflar\u0131n bo\u015fanmak istemesi ve birlikte mahkemeye ba\u015fvurmas\u0131 yeterlidir.<\/p>\n<p>Anla\u015fmal\u0131 bo\u015fanma davas\u0131 a\u00e7\u0131labilmesi i\u00e7in dava dilek\u00e7esi ve taraflarca haz\u0131rlanan protokol\u00fcn mahkemeye sunulmas\u0131 gerekir. Protokol\u00fcn i\u00e7eri\u011fi \u00f6nemlidir; zira imzalanan protokol daha sonra bo\u015fanman\u0131n sonu\u00e7lar\u0131na ili\u015fkin dava a\u00e7ma imkan\u0131n\u0131 ortadan kald\u0131rabilir.<\/p>\n<\/div><div class=\"bt_bb_separator bt_bb_border_style_none bt_bb_bottom_spacing_normal bt_bb_hidden_md bt_bb_hidden_lg\" data-bt-override-class=\"null\"><\/div><\/div><\/div><\/div><div  class=\"bt_bb_column col-xl-4 bt_bb_align_left bt_bb_padding_normal bt_bb_animation_fade_in animate\"  data-width=\"4\" data-bt-override-class=\"{}\"><div class=\"bt_bb_column_content bt_bb_vertical_align_bottom bt_bb_color_scheme_\"><div class=\"bt_bb_column_content_inner\"><div  class=\"bt_bb_text\" ><p>Bo\u015fanma protokol\u00fcnde taraflar\u0131n bo\u015fanmak istedi\u011fi, m\u00fc\u015fterek \u00e7ocuk varsa e\u011fer velayetin kime b\u0131rak\u0131ld\u0131\u011f\u0131, nafaka belirlenmi\u015fse t\u00fcr\u00fc ve miktar\u0131, tazminat belirlenmi\u015fse t\u00fcr\u00fc ve miktar\u0131 gibi bilgilere yer verilir.<\/p>\n<p>\u00a0<\/p>\n<p>H\u00e2kim, protokoldeki h\u00fck\u00fcmlerle ba\u011fl\u0131d\u0131r. Bo\u015fanmak isteyen ki\u015fi taraf\u0131ndan her zaman e\u015fe kar\u015f\u0131 a\u00e7\u0131labilir.
